NOVEMBER 5, 2023
To: All Interested Agencies, Groups and Individuals
This is to give notice that the Florida Department of Commerce (FloridaCommerce) has conducted an evaluation as required by Executive Order 11988 in accordance with U.S. Department of Housing and Urban Development (HUD) regulations at 24 CFR 55.20 Subpart C to determine the potential effects the Rebuild Florida Program’s activity in the floodplain will have on the environment.
Through Rebuild Florida, home repairs, reconstruction or replacement may be performed on properties located within the 100-year floodplain. • Temporary Housing Assistance based on individual homeowner needs and their participation in HRRP.
• Temporary Housing Assistance based on individual tenant needs and their participation in HRRP.
• Repairs to seawalls that were damaged by the 2022 hurricanes and are necessary to stabilize property and control erosion on a site also receiving assistance for home repair, reconstruction, or replacement.
• FloridaCommerce may also consider providing reimbursement for repairs to housing units damaged by the 2022 hurricanes that were completed prior to the homeowner’s application for the Rebuild Florida program.
FloridaCommerce has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values.
A: Homes to be rebuilt in their original location are to be elevated, adhering to federal, state and local requirements, and at least two feet above base flood elevation.
B: Mobile Home Units may be replaced with modular units and elevated, adhering to federal, state, and local requirements, and at least two feet above base flood elevation.
C: Damaged homes may be relocated within the homeowner’s currently developed property with possible elevation in accordance with floodplain requirements.
D: Relocation and replacement of damaged mobile homes to a previously developed mobile home lot outside the 100-year floodplain.
All homes assisted through the program within the 100-year floodplain will require the maintenance of floodplain insurance in perpetuity.
A no action alternative was rejected because residents would not be provided with assistance rebuilding and recovering from the 2022 hurricanes.
While the project will be located partially in the 100-year floodplain, limiting the scope of the project to areas outside the 100-year floodplain would prevent the program from providing recovery assistance to a substantial portion of the low- and moderate-income families that were impacted by the 2022 hurricanes. Therefore, it has been determined there is no practicable alternative to locating the proposed project in the 100-year floodplain.
The proposed improvements will conform to applicable floodplain protection standards. The proposed action is not expected to negatively impact current natural or beneficial floodplain values, and residents of the community will benefit from the project. Failure to provide these improvements will make it difficult for residents to recover from the 2022 hurricanes and result in unrepaired, vulnerable structures remaining in flood prone areas where they can be subjected to further damage which will cause future negative overall impacts.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplains and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public education tool and can facilitate and enhance federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the federal government determines it will participate in actions taking place in floodplains, it must inform those who may be put at greater or continued risk.
